ESH Terms & Applicable Conditions when our rubbish removal service is booked.

When you Accept and BOOK a private, business or NDIS job with our Easy Skip Hire & Rubbish Removal team, this constitutes acceptance of our terms and conditions in full. Acceptance of a booking, Invoice or service from ESH is acceptance of the below Terms & Conditions.

Terms & Conditions

ESH Cancellation Policy

1A. If a Cancellation is made in writing to ESH 24 hours or more before to the confirmed booking day/date and time, then there is no cost to cancel.

1B. If you cancel a booking providing no notice or less than 24 hours notice to ESH of your confirmed booking day/date (or upon ESH team arrival so in effect a last minute cancellation) then ESH reserves its lawful rights to charge a booking cancellation fee of $299. This cancellation fee is chargeable at the sole volition of the ESH based upon each unique booking circumstance.

1C. If our team has started to load your rubbish and you choose to cancel and have the waste unloaded a cancellation (inc unloading) fee of $299 strictly applies.

1D. In such instances to avoid a complete cancellation and no rubbish being removed for your $299, we can reduce your loaded waste to our min job size of 2 cubic metres x your applicable rate plus a $100 unloading fee. In this instance no additional costs will be incurred. Example 2 x $99 per cubic metre plus $100 ex GST.

1E. We always strongly encourage you to sms or email photos of your waste so we can assist in estimating volume and advising the applicable rate per cubic metre for your specific job prior to booking. Best practice is to send images from a multiple angles to try and help us understand the length, width, height and waste types of your job.

ESH Payment Policy

2A. All service fees (the bill total) are to be made once the ESH once the service is finalised. We require payment in full before leaving the job site. We offer flexible Payment terms including debit or credit card, cash or bank transfer (only if agreed prior to commencing the job).

2B. If your completed and fully loaded job is cancelled and you wish for it to be unloaded after payment is disputed, you (the client) understands that you have specifically provided ESH with the legal confirmation to bill a cancellation fee of $499 for up to half a truck load and $999 for any load beyond half a truckload up to and including a full truck load payable same day. We will to return your waste close to where the truck is parked.

2BB. In the event where it has been expressly prior agreed we can complete your job and take payment after leaving site and you choose not to pay, ESH reserves all rights to return a similar waste volume or value to the property when convenient for ESH to do so at an access point convenient for ESH truck access.

2BBB. If your originally collected waste has been emptied and you fail to pay if agreed in section

2BB then the full amount is payable on the spot, no terms are available. Should you not pay it ESH will commence debt recovery & applicable legal action which will be added to your job cost and overall liability, this is typically is a minimum additional cost of $1500-$2500.

2D. If your job is NDIS funded, when you book and provide your NDIS participant number you are also confirming the following;

2DD That you have sufficient funds to cover the job you have engaged ESH for.

2DDD That you reserve funds for our invoice rather than have funds available at the time of booking but you spend them elsewhere in effect rendering low or no funds to cover our invoice.

2DDDD In the event of non NDIS payment for any reason, the costs clause below is applicable to you personally and you remain liable for the invoice cost personally. In lamens terms, if you cannot settle your bill with ESH via your NDIS funding, you must pay us directly. We will supply an NDIS compliant tax invoice which you can then claim from NDIA. Failure to pay will also see payment collection costs added as listed in section 2BBB.

ESH Costs Clause – When you book a job or rubbish removal pickup you accept the costs clause in full.

3A. I or we (refers to the client or individual who booked this job and scope of works including NDIS participants) acknowledge that if the account is overdue beyond 14 days, ESH at its sole discretion preserves all legal rights to send your outstanding bill to a Mercantile Debt Collection Service for recovery & collection. Further when you book you acknowledge that all debt recovery costs that the agency will be accrued to your original outstanding bill amount which includes any legal fees received by ESH to collect the outstanding bill amount in full, These costs typically start at an average of $1500-2400.

3B. Any bills or invoices that are 30 days outstanding from the invoice date (including NDIS SUBMITTED INVOICES) will be sent to Victorian Civil and Administrative Tribunal (also known as VCAT) for a private hearing to establish ESH’s claim for the overdue bill total. Where a unpaid bill reaches the stage that a VCAT hearing is needed ESH will apply an additional admin fee of up to $750 exclusive of any fees payable to VCAT.

3C. Where we mention “Supplier” this refers to Easy Skip Hire & Rubbish Removal team (ESH) as being the rubbish removal service provider.

3D. Where we mention Client / Customer / NDIS Participant: We refer to the individual(s), NDIS provider, carer or Organisation named on the booking or person responsible for booking (hiring) the ESH service. If more than one person has booked the job then both will be accountable for any outstanding invoices and recovery costs.

3E. Household waste: Refers to domestic items typically found in the home in residential quantities. Items considered household junk include items like white goods, furniture, IT and electrical items. See link here for details.

3F. Green waste: Refers to all green waste types however, items that are subject an additional 20% cost at ESH discretion include Yucca plans, Agave Plants, large thick trunks or branches and root-balls. These need to be able to be safely lifted and removed to be accepted. See link here for details.

3H. Light Construction waste: Refers items like timber, window frames and general light weight building materials. See link here for details.

3I. Heavy Construction waste: Refers to items on mass that are heavy like hardwood, plaster sheeting, gip-rock, cement sheeting and other items typically found on building and commercial work sites. See link here for details.

3J. Heavy rubble JUNK: Refers to Concrete, tike, brick and rock that can be safely lifted and not commingled with any other waste types. Soil and large rock, mixed waste types with the rubble are not accepted. See link here for details.

What is a Cubic Metre?

This is the volume of space or area of waste which is calculated using the following formulae. Height 1m x Width 1m x Depth 1m = 1 cubic metre (for reference imagine roughly 4 small council bins if gathered together.

We establish and measure your collected volume once its loaded into our mobile bins. It is then charged for the actual volume we collect multiplied by the applicable rate (so waste type may be for example Free waste, then its $99 ex GST x actual volume = you’re bill total). A 2 cubic metre min charge applies for all jobs within 35km of Melbourne CBD and 3 cubic metre min fee applies for jobs 36km+ from Melbourne CBD.

Hazardous Materials: This typically means waste types that must not be collected or removed under State or Federal law. Examples may include but are not limited to paint, oil, pesticide, all chemical types, some timber types like MDF or some treated timbers, oil drums and fuel/drums, asbestos, explosive items (hydrants, gas bottles) or other toxic waste types.

Additional Terms & Conditions

Any estimate of volume given based upon your supplied pictures to ESH is a best estimate, not a fixed price Quotation. An estimate also can be provided based exclusively on the verbal explanation provided to or pictures sent to ESH from the client in an effort to try and establish an estimate of volume and rates. We charge for your exact volume X the applicable rate for your waste types and any additional recycling fees if applicable. Waste collected must match pictures sent to ESH for estimates to be as accurute as possible.

ESH rubbish collections apply at the rates of $99 ex GST per cubic metre for Domestic, Household and Green Waste types. NDIS jobs are more flexible in what waste types we will accept and include in the rate which is $122 ex GST per cubic metre. Light Construction waste is $125 ex GST per cubic metre. Heavy Construction waste is $150 ex GST per cubic metre. Heavy Rubble only (cannot commingles with other waste types) is $195 ex GST per metre cubed. The per cubic metre rate is established based upon the type of rubbish or waste that makes up 60% or more of the waste/rubbish collected.

You the client agree and understand that by booking with ESH you indemnify the supplier (ESH) that the waste does not contain any prohibited waste types whatsoever (known to you or unknown to you). For more information on prohibited substances and waste types refer to the Victorian State Government website.

Asbestos material collection is strictly illegal, no exceptions heavy penalties apply for any concealed asbestos in loads. ESH may choose to report you the client for attempting or concealing asbestos within your rubbish piles to the EPA. In the event that we did collect asbestos or any other illegal waste types that are concealed by the client ESH will bill the client for the costs to dispose of said waste legally and safely. The client will automatically be reported to EPA where Massive penalties may also apply.

On arrival at your booking time and day, the client understands they must provide clear and safe access for the ESH team to collect your waste. If access is blocked and our staff are unable to safely load the rubbish onto the truck/mobile bin, then the client will be advised typically over the phone, sms message or email. In access is obstructed or further than 25 metres from the trucks parked location, an additional fee of $50 per cubic metre may apply at the sole discretion of ESH. In the event that access to the rubbish is unsafe under OH&S requirements, the worksite (your residence, office, job site etc is deemed to be the work site if that’s where the waste is booked to be collected from) will be vacated and a 2 cubic metre min charge x the applicable rate will be charged and is payable in full at that time.

Your ESH booking includes ESH team members, travel time to site, all tip fees and an allowance of up to 3 hours on site for your rubbish removal job unless prior agreed at time of booking.

When a client or individual confirms a booking, it is reasonably assumed that access to the site is safe and compliant with all OH&S legal requirements. These include being free from any over head cables or structures lower than 3m in height. Parking or driveway/lane access needs to accomodate a vehicle typically 20% larger than a 4WD or large UTE like a Ford Ranger as a reference point and be able to support up to a 6 tonne vehicle. Site access must also not impact pedestrians, cyclists and other road or footpath users.

If your site access is not on ground level (and we were not advised prior to booking confirmation of this) and requires the use of a lift then further charges may apply ($50 per cubic metre in addition to your waste type rate). You are obliged to advise us at time of booking that there are stairs and the details therein under OH&S requirements and loading in the case of stairs being present is at the discretion of the ESH team.

In the event that the supplier has not been paid in full (and no payment arrangements have been made) after a reasonable amount of time (7 business days) the client agrees that the supplier can dump a similar amount of rubbish (in volume or value) to what was originally collected back to the client’s site address without notification at an access point most suitable for the truck and driver to safely do so.

We receive the rights to apply a 3% card payment fee which may change from time to time as deemed by third party eftpos suppliers.

By booking with ESH the client understands and agrees to indemnify the ESH from any potential damage, claim or legal claim against ESH. Claims you indemnify ESH include loss of income or potential income and and all personal injury. You also agreed to indemnify ESH from any potential property claim damage.

You expressly understand that ESH will not be held liable for any loss, damage, injury of death arising either directly or indirectly from the performance of its employees or contractors.

When you book with ESH it implies and clearly means that you have read and understand the aforementioned Conditions & Terms in full (whether you chose to send pictures or not) with which you were supplied a direct link to via sms or email prior to booking. Our terms and conditions are subject to change from time to time.
